Your Rights At The Border
Your Rights At The Border
U.S. citizens, a great read on having no rights until you are back in the United States. On the other side of the line, the Constitution does not apply.
Yes, customs can take your mobile device and ask you for the password to access all of your information.
_It’s totally legal for a US Customs and Border Patrol officer to ask you to unlock your phone and hand it over to them. And they can detain you indefinitely if you don’t. Even if you’re a American citizen.
The border is technically outside of US jurisdiction, in a sort of legal no-man’s-land. You have very few rights there. Barring the use of “excessive force,” agents can do whatever they want to you.
So my advice is to just do whatever they tell you, to and get through customs and on into the US as quickly as you can._

let's see what stories like this one are doing to the tourism to the US... In all seriousness, these days I'd think twice about traveling to the US on holiday. Too much weird crap going down over there.
ReplyDeleteHello how are you ding George
ReplyDeleteWow, scary. Just a few months ago, an article like this would have bounced off my radar, Zara Altair. While legally true, I suppose, civic norms would have prevented any standing US president from allowing such behavior to occur under their watch. Now? No longer a guarantee.
ReplyDeleteGideon Rosenblatt Yes, and I had a taste of this on my recent trip but not the U.S. My traveling companion misplaced her passport. At the airport in Mexico I had already "entered." We were not allowed to talk to each other even though we were only about 15 feet apart with nothing between us but air. I was escorted away through customs by the Guardia Nacional separating us even further. The story is longer than that and the issue was resolved, but for 1 1/2 hours we were not allowed to communicate. She was about to be deported on the next plane out, when a customs agent finally brought me back to the "outside." We found the passport and all was resolved.
ReplyDeleteWow, that's horrible, Zara Altair. It's times like that when you really feel the power of the state in a way that we normally don't in everyday life.
ReplyDeleteTwo months ago l had to travel to Smalia Mexico fromin San Diego CA to see my fatheur that was oneeding my omrecent trip l put my trust in god that he would bless us at all times not onlyn tsinyaloa but across us custom knowing ware we were coming from but l was very aware of the importance of my visa passport that l had not requested in time l explained to custom the emergency and they were very polite to us. My best advice to you is god's cell phone it works at all times
ReplyDeleteGideon Rosenblatt Yep, a very intense time.
ReplyDeleteI disagree with the USA CBP position. I'd be willing to make them argue their position in Court-in my case anyway...
ReplyDeletewhy are your panties all in a bind. Screw this ACLU BS. I'd give them my Obama phone in a heartbeat. I've nothing to hide and am not the least bit upset by it. If you lose your passport what do you think a border agent is going to think? Another illegal trying to sneak in! If it catches wackos coming into the country go for it
ReplyDelete"I've nothing to hide," says the person who is hiding his name and real face.
